After hearing learned counsel for the Petitioner at length, we found that the matter has not been dealt with properly by the Disciplinary Authority, inasmuch as in spite of the fact that the Inquiry Officer had recorded a finding of guilt, a meager punishment of only stoppage of two annual grade increments was imposed although, the charge related to demand of bribe.

We feel that the letter appended as Annexure P-4 and the call transcript warranted much severe punishment/penalty. 3.
We therefore, posed a question to Mr. Ankur Chibber, learned counsel for the Petitioner that in case we decide the case on merit, his client may run the risk of enhancement of the punishment in case we ultimately dismiss the writ petition.

He request to pass over the matter so as to complete his instructions from his client as to whether he wishes to pursue the writ petition or wants to withdraw the same.

Mr. Chibber appeared after a telephonic conversation with the client and on the basis of the instructions/message received from the Petitioner, he sought permission to withdraw the present writ petition. 6.
Permission is granted.

The writ petition is dismissed as withdrawn.

The observation made hereinabove are our prima-facie view and the Respondents shall not enable the Respondents to reopen the matter.
