The accused/applicant seeks regular bail in case FIR No. 79/2023 of PS EOW for offence under Section 406/409/420/120 IPC. 2.

This regular bail application got listed before the predecessor bench for the first time on 12.02.2025. Thereafter, the application remained pending before different benches and has been assigned to this bench as a part of 179 old pending bail applications. Today being the first date before me, I have heard learned counsel for accused/applicant and learned APP. I have also heard learned counsel for complainant de facto as well as learned legal aid counsel for the investors.

After addressing at length, on being pointed out that at the time of alleged collection of money, the accused/applicant did not possess any requisite sanctions to open a water treatment plant and he did not pay any commission even from the profits initially earned from cafe, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court after consideration of charge. 4.

The IO/Inspector Dharmender has not appeared. 5.

As requested, the bail application and the accompanying applications are dismissed as withdrawn with liberty as sought.
