1. None appears for the Appellant. By an order dated 25th March 2003, the sentence of the Appellant was suspended upon his furnishing personal bond in the sum of Rs.3,000/- with one surety in the like amount to the satisfaction of the trial Court. The investigating officer who originally investigated the case, and who is now retired, is present in Court. He confirms that the Appellant is a permanent resident of Nepal.
2. In the circumstances, there is no scope of the notice being sent to the Appellant and for it to be served.
3. The bail bonds and surety bonds of the Appellant are cancelled. The appeal is dismissed with the direction that the SHO will make earnest efforts CRL.A. 647/2002
to trace and arrest the Appellant and send him to jail. Soon thereafter, the SHO will apply to this Court to have the present appeal revived for hearing. S. MURALIDHAR, J.
