O R D E R

% 07.01.2016 The petitioner has filed the present petition under Article 226 of the Constitution of India inter alia seeking quashing of election notification/notice dated 09.12.2015, to direct respondent No.2 to hold de novo elections after proper compliance of the Memorandum of Association and quashing the appointment of the Acting Vice Chancellor's wife as the President.

Learned counsel for the petitioner submits that Prof. Ruchi Das, who is wife of the Registrar is contesting elections for the Executive Committee. He also submits that the Registrar of Delhi University has appointed Mr.Vikas Gupta, Joint Registrar (Colleges) as the Returning Officer for DUWA Executive Committee election. He further submits that proper procedure has not been followed in terms

of the Memorandum of Association.

Mr.Mohinder J.S. Rupal, enters appearance on behalf of respondent No.1 on advance notice.

Mr.Sudhir Nandrajog, learned senior counsel for respondent No.1 submits that the petition is not maintainable and the petitioner has no locus to file the present petition. He further submits that the result of elections of Executive Committee of Delhi Women's Association (DUWA) has been declared and notification dated 02.01.2015 has been issued.

A copy of said notification has been placed on record and the same handed over to counsel for the petitioner today. At this stage, Mr.Pankaj Sinha, learned counsel for the petitioner seeks permission to withdraw the present petition as well as application with liberty to file fresh petition. As prayed, the petition as well as application are dismissed as withdrawn.
