The present writ petition has been filed under Article 226 of the Constitution of India seeking inter alia, direction to the respondent no. 2 to allow the form TM-M filed by the petitioner on 16th July, 2024 for amendment of specification of goods, in application no. 5389494 in Class 35, whereby the petitioner deleted 'ANDROID' from the specification of goods.

Today, learned counsel appearing for the petitioner submits that after the filing of the present petition, the Trade Mark Registry has allowed the request of the petitioner in the form TM-M filed by the petitioner on 15th July, 2024 and has amended the specification of goods by dropping 'ANDROID' from the clarification of goods in the petitioner's application. He, thus, submits that his grievance stands satisfied. 4.
This Court further notes the submission made by learned counsel appearing for the petitioner that the trademark registration has already been issued in favour of the petitioner.
