Counsel for appellant states on instructions that the legal heirs of appellant nos.1 and 3 Mr. Kamal Kumar and Mr. Surender Kumar Aggarwal, who had since passed away, are not interested in pursuing the matter as they are not continuing this business.

As regards appellant no.2, it is the trading company through its proprietor appellant no.1 and therefore would be covered under the same instructions.

As regards the appellant no.4, counsel states on instructions that he does not pursue this appeal as he is not in the business of ball bearings; appellant no.4 submission forms part of the learned Trial Court record, as stated by counsel for appellant.
