Learned APP for State submits that petitioner surrendered in custody during interim bail, since he was taken in custody in another case under Sections 138/141 NI Act. He further submits that as chargesheet as well as supplementary chargesheet have since been filed before the learned Trial Court, petitioner may invoke the jurisdiction of learned Trial Court in first instance.

In the facts and circumstances, learned counsel for petitioner seeks to withdraw the application without prejudice to the rights and contentions of the petitioner, with liberty to file bail application before the learned Trial Court and thereafter prefer an application before this Court, in case the petitioner is aggrieved against orders passed by the learned Trial Court. 3.
