Petitioners are facing a trial in connection with a complaint filed under Section 138 of Negotiable Instruments Act, 1881 and are aggrieved by order dated 30.01.2026 whereby their prayer to recall defence witness has been closed.

However, the final arguments were also heard by the Court and, simultaneously, the Court had fixed up the matter for pronouncement of judgment.

Learned counsel for the petitioner, in all fairness, submits that the learned Trial Court has already pronounced the order of conviction yesterday and now the matter is fixed for hearing arguments on sentence. 4.

In view of the abovesaid peculiar development, the present petition does not survive.

The present petition is, accordingly, disposed of as having become infructuous.

However, needless to say, as and when the petitioner herein chooses to file any appeal, challenging the abovesaid order on conviction, it would be at liberty to incorporate in grounds of appeal about the prejudice caused to him by order dated 30.01.2026, which is impugned herein. 7.

Pending applications also stand disposed of in aforesaid terms.
