O R D E R

% 11.01.2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner seeking quashing of FIR No.638/2014, under Sections 279/338 IPC, registered at Police Station Ghazipur, Delhi and all proceedings emanating therefrom.

Counsel for the petitioner submits that the petitioner was driving the Car bearing registration No.DL 7C-L-1198 (Hyundai I-20) on 10.09.2014 very cautiously, but when the Car reached the Ghazipur flyover, due to error of judgment, met with an accident with the Motor Cycle bearing registration No.DL 5S Ak-9392, resulting into registration of the aforesaid FIR against the petitioner. Counsel further submits that after the registration of the FIR, the near friends and relatives intervened and the matter has been amicably

settled/compromised between the parties vide compromise deed which has been reduced into writing on 26.11.2016 for the betterment of the parties. Counsel further submits that since the matter has been amicably settled between the parties and nothing further remains to be adjudicated between the parties, no purpose would be served by continuing criminal proceedings against the petitioner and prays that the aforesaid FIR, which is coming as a hurdle in leading peaceful life of the parties in near future, may be quashed. The respondent No.2/complainant is present in Court today and has been identified by the substituted IO SI Praveen Kumar and his counsel, Mr.Shantanu Bhardwaj, Advocate. The respondent No.

2/complainant admits the factum of amicable settlement with the petitioner and further admits that the said settlement/compromise is voluntary and without any force, pressure or coercion and submits that he has no objection if the FIR is quashed. Looking into the above facts and circumstances, since the matter has been amicably settled/compromised between the parties and nothing further remains to be adjudicated, I deem it appropriate to quash the FIR in question. Consequently, to meet the ends of justice, FIR No.638/2014, under Sections 279/338 IPC, registered at Police Station Ghazipur, Delhi and all proceedings emanating therefrom are hereby quashed. The present petition is allowed and stands disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.
