O R D E R

This is a petition filed under Section 483 of BNSS seeking grant of regular bail to the petitioner in FIR No. 533/2023, dated 06.07.2023, registered at PS Sarai Rohilla under section 302 of IPC, 1860. 2.

As per the FIR, an altercation took place between Abhishek @ Dancer and Mr. Kamal (the deceased). Subsequently, Abhishek took out a knife and stabbed Kamal multiple times. During the attack, the petitioner was standing beside him on the scooty. Thereafter, Kamal succumbed to the injures caused to him.

Mr. Sharma, learned counsel for the petitioner states that in the present case, the petitioner is not the one who has stabbed the deceased and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

He further states that the petitioner is a young boy aged about 20 years and has been in custody since 07.07.2023. 5.

On the last date of hearing i.e. 12.02.2025, the status report was called from the respondent and the same has been handed over in court today. 6.

As per the status report, accused, Abhishek @ Dancer and the petitioner was arrested on 07.07.2023 and a scooty bearing no. DL1SFA 4497, which was used in the offence was recovered from the residence of the main accused i.e. Abhishek @ Dancer, at the instance of the petitioner. Furthermore, at the time of recovery, the scooty had bloodstains on it, and its front main plate was also broken. Additionally, one mobile phone was also recovered from the possession of the petitioner. 7.

Upon seeing the CCTV footage, it is found that the main accused, Abhishek @ Dancer, and the petitioner were together at the scene where the alleged offence took place. After the murder was committed, both of them were seen fleeing the location on the scooter, with the petitioner riding it. 8.

The petitioner has also refused to participate in the TIP. 9.

In the present case, the petitioner is involved in a heinous and serious offence, as evidenced by the CCTV footage, which shows the petitioner fleeing the spot of crime alongside the main accused, Abhishek. Further, the scooty used in the commission of the offence has also been recovered at the instance of the petitioner.

To my mind, the trial is at the initial stage and if the petitioner is released on bail, there are apprehensions that he might jump the bail and also influence the witnesses.

For the said reasons, there is no merit in the petition and the same is accordingly dismissed.
