The instant petition under Section 482 of the Criminal Procedure Code read with Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") has been filed by the petitioner praying for quashing of FIR 41/2023 registered at Police Station Anand Vihar on 12.02.2023, for offences punishable under Sections 279/338 of the Indian Penal Code, 1860 (hereinafter "IPC").

The petitioner is present before this Court and has been identified by her counsel Mr. Hari Krishan Pandey and Investigating Officer, Police Station Anand Vihar. Respondent no. 2 is also present in the Court and has been identified by her counsel and the Investigating Officer. On a query made by this Court, respondent no. 2 has categorically stated that she has entered into compromise on her own free will and without any pressure. It is also stated by her that the entire dispute has been amicably settled between the parties.

The brief facts of the case are that the respondent no. 2 is the resident of H. No. 211, Govind Khand, Vishwa Karma Nagar, Jhilmil, Vivek Vihar, Delhi-110095. The petitioner and the respondent no. 2 were involved in a road accident on 12.02.2023. Respondent no. 2 sustained injuries due to a collision with a Mercedes, resulting in an FIR 41/2023 being lodged. 5.

Learned counsel appearing on behalf of the petitioner submitted that chargesheet has already been filed against the petitioner. It is submitted that the petitioner and respondent no. 2 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. It is further submitted that respondent no. 3 has been duly compensated for the injuries suffered by her along with his medical expenses by the petitioners. 6.

Memorandum of Understanding dated 08.08.2024 is on record and has been annexed as Annexure P-20. Qua this deed, respondent no. 2 has agreed to withdraw the case arising out of FIR 41/2023 registered at Police Station Anand Vihar against the petitioners.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 8.

Mr. Satish Kumar, learned APP for the State, submitted that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 9.

Keeping in view the fact that the matter stands amicably been settled between the petitioners and respondent no. 2 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 11.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR 41/2023 registered at Police Station Anand Vihar, for offences punishable under Sections 279/338 of the IPC, and consequent proceedings emanating therefrom, are quashed subject to payment of cost of Rs. 25,000/-, which shall be deposited with the 'CDCBA Members Welfare Fund Account' bearing A/c No.33640110020388 (IFSC Code: UCBA0003364) maintained with the UCO Bank, Rouse Avenue Court Complex, New Delhi within a period of one week from today. The receipt of payment is to be deposited and verified by the concerned IO.
