The accused/applicant seeks regular bail in case FIR No. 631/2023 of PS Geeta Colony for offence under Section 365/302/34 IPC. 2.

Broadly speaking, allegation against the accused/applicant is that with the help of two other accused persons, he kidnapped the deceased and killed him because the deceased and his brother had relations with sister of the CCL. Learned APP for State has shown the CCTV footage of the deceased being taken away by the said three persons at about 07:43pm, after which the dead body was for the first time recovered at 08:20pm on the same day. It is also stated that TIP was successful.

testimony of Joginder. But learned counsel for accused/applicant submits that Joginder is not appearing for his testimony from Dubai. 4.

Apart from that, learned APP for State submits that the CCTV footage depicting the alleged kidnapping also has to be proved and the same shall be done on priority basis.

In above circumstances, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the learned trial court after testimony of Joginder or after the CCTV footage is proved.

As requested, this bail application and the accompanying application are dismissed as withdrawn with liberty as sought.
