By way of the instant petition, the petitioner seeks setting aside of the impugned order dated 22.12.2025 passed by the learned Additional Sessions Judge/Special Judge, NDPS, New Delhi in SC No. 75/2023 and allow the petitioner to appear before the Court through video conferencing, during the course of trial of the case.

The learned counsel appearing on behalf of the petitioner states that the petitioner herein is suffering from diabetes, due to which he suffers from frequent urination (polyuria), and also experiences severe anxiety/nervousness in crowded environment, and therefore, it is difficult for him to travel from jail to the Court and from Court to the jail. The learned counsel for the petitioner states that his only limited prayer is to allow the petitioner to appear through video conferencing, and there is no request that the trial be stalled, due to his non-appearance. 6.

In these circumstances, it is ordered that the petitioner can appear through video conferencing during the course of trial, unless he is required to appear in person by the learned Trial Court. 7.

The learned counsel for the petitioner will specifically mention and file an application before the learned Trial Court that during the course of trial, in case, the petitioner appears through video conferencing, at no point of time, his counsel will seek adjournment, or dispute his identity. 8.

In view of above, the present petition is allowed and is accordingly disposed of.
