The learned counsel appearing for the petitioner seeks to withdraw the present petition. He states that the order under Section 263 of the Income Tax Act, 1961 pursuant to which the Transfer Pricing Officer order was passed has been set aside by the learned Income Tax Appellate Tribunal and, therefore, the petitioner's grievance stands addressed. 2.

Accordingly, the petition is dismissed as withdrawn. The pending application is also stands disposed of.
