% 23.01.2024 Present appeal has been preferred on behalf of the appellant under Section 374 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') against judgment dated 10.04.2003 and order on sentence dated 16.04.2003 whereby the appellant was sentenced to undergo Rigorous Imprisonment (RI) for three years and fine of Rs.1,000/- (in default of payment of fine to further undergo SI for 15 days) for offence punishable under Section 326 IPC. Learned APP for the State submits that appellant expired on 27.03.2021 and cremation slip has been verified. In view of above, proceedings against the appellant stand abated. Appeal is accordingly disposed of. File be consigned to Record Room.
