1. Learned APP informs the Court that there is a report of the Sarpanch Gram Panchayat, Bupania, PS Bahadur Garh, District Jhajjar, Haryana to the effect that the Appellant has sold away his land and is no longer residing at the address given by him. His parents have also expired.

2. The Appellant has not complied with the conditions under which his sentence was suspended by the order dated 6th November 2006 and modified by the order dated 8th November 2006.

3. Accordingly, the bail bond and surety bond furnished by him in terms of CRL.A.32/2003

the said orders are hereby cancelled. The appeal is dismissed.

4. It is, however, directed that as soon as the Appellant is taken into custody, the SHO concerned will inform the APP for mentioning of the appeal for listing and revival of hearing.
