Petitioners seek quashing of FIR No.310/2013 of Police Station R.K. Puram, Delhi under Section 498-A/406/34 IPC on the ground that complainant de facto (respondent no. 2) has compromised the disputes with the petitioners.

Respondent no. 2 accompanied with her counsel and identified by Investigating Officer/SI Arti accepts notice. Learned APP also accepts notice.

respondent no. 2 with lathis and dandas causing them injuries which led to calling of PCR by mother of respondent no. 2 and the injured persons were taken to hospital and got treated there. Not only this, it appears from FIR that nine months old daughter of respondent no. 2 was beaten so badly that it caused blue marks and swelling on her head. Even thereafter, according to FIR, petitioner no. 1 assaulted the mother and younger brother of respondent no. 2 with danda regarding which PCR was called but local police did not take any action.

At this stage, in the course of dictation, learned counsel for petitioners seeks permission to withdraw this petition with liberty to raise during trial all defences as raised in the present petition. 6.
