The present Petition under Article 226 Constitution of India read with Section 528 BNSS has been filed on behalf of the Petitioners seeking to quash the FIR No. 90/2023 registered under Sections 420/120B of the Indian Penal Code, 1860 registered at Police Station Cyber Police Station (SouthEast), New Delhi. 2.

Brief facts of the case are that Petitioner who was in the business of auto sales offered a deal for vehicle Mahindra Thar to Respondent No.2, pursuant to which Respondent No.2 transferred a total sum of Rs.40,000/- i.e. Rs.15,000/- on two occasions and Rs.10,000/- on one occasion to the Petitioner. The Petitioner could not provided the vehicle to Respondent No.2 before the agreed date of 08.07.2023 whereafter Respondent No.2 filed an Online Complaint on 23.11.2023 for financial fraud resulting in registration of FIR No.90/2023 under Section 420/120-B at Cyber Police The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Station (South-East), New Delhi. It is submitted that the FIR has been registered by Respondent No.2 against the Petitioner due to some misunderstanding.

It is submitted that the Petitioner and Respondent No. 2 have already sorted out their all differences vide Memorandum of Settlement dated 07.02.2025, with the intervention of their family members and friends and they have left no grudge or grievance against each other in any manner whatsoever. It is further submitted that the Settlement has been arrived at between the parties voluntarily and without any force, pressure or coercion. Therefore, the Petition be quashed.

The Complainant/Respondent No.2 is present in the Court and submits that the matter stands settled with the Petitioner and that he has no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties. 5.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 90/2023 registered at Cyber Police Station (South-East), New Delhi, for offences punishable under Sections 420/120-B of the Indian Penal Code, 1860 with all the subsequent proceedings and the Chargesheet is hereby quashed qua the Petitioner. 7.

The Petition stands disposed of.
