By way of present application, the applicant seeks grant of regular bail in case arising out of FIR No. 187/2024, registered for offence punishable under Sections 109/363/366/376/506/34 of Indian Penal Code, 1860 (hereafter 'IPC') read with Section 6/17/21 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act'), at Police Station Aman Vihar, Delhi.

The learned APP for the State submits that the victim in this case is not traceable. The father of victim, who appears before the Court, also admits the fact that the victim is untraceable. The allegations against the present applicant are that while the main accused had sexually assaulted the victim on false pretext of marriage, the applicant herein had given a room to the main accused on rent, on a few occasions. The present applicant has been in judicial custody since 13.05.2024.

The learned counsel appearing on behalf of the applicant states that the case is now listed before the learned Trial Court for recording of evidence of the victim on 14.05.2025.

Concededly, the victim is not traceable and another FIR/missing report has been lodged by the father of the victim himself. The applicant has been in judicial custody for about 10 months. Considering the same, this Court is inclined to grant regular bail to the applicant on his furnishing personal bond in the sum of Rs.15,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned on the following terms and conditions: i.
The applicant shall not directly or indirectly contact the victim or her family members and not to make an attempt to influence the witnesses, or tamper with the evidence in any manner.

The applicant shall share her mobile number with the concerned IO/SHO, and shall keep the same switch on/active at all times.
