CRL.M.C. 1459/2026 & CRL.M.A. 5863/2026 W.P.(CRL) 625/2026 & CRL.M.A. 5887/2026 3.

By way of present petitions, the petitioners seek quashing of two FIRs, i.e. FIR bearing no. 358/2022, registered at Police Station Sarai Rohilla, Delhi, for the commission of offence punishable under Sections 323/376/376(2)(n)/109/506/509/34 of the Indian Penal Code, 1860 (hereafter „IPC‟) and FIR bearing no. 260/2022, registered at Police Station Gokul Puri, Delhi, for the commission of offence punishable under Sections 498-A/406/34 of the IPC.

4.

The petitioners and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officers (IO) from concerned Police Stations.

5.

Briefly stated, facts of the present case are that the marriage between petitioner no. 1 and respondent no. 2 was solemnized on 07.05.2019 as per the Hindu rites and customs and were living with each other. No child was born from their wedlock. After some time, due to different lifestyles and temperamental differences, both the parties could not reside with each other and since 25.12.2019, petitioner no. 1 and respondent no. 2 have started living separately from each other. Thereafter, on the complaint of respondent no.2, the aforementioned FIRs were registered against the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

petitioners under the relevant sections. The allegations in FIR no. 358/2022 against the father-in-law and brother-in-law are under Section 376 of the IPC.

6.

It is stated that both the parties have amicably settled the present matter vide Settlement dated 14.10.2025, entered between them before the learned Judge, Family Court, Central District, Tis Hazari, Delhi. The balance compromise amount of Rs.2,50,000/- has been given to respondent no. 2 in Court, by way of a Demand Draft bearing No. 084623, dated 09.04.2026 drawn on State Bank of India.

7.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. She also states that she does not want to pursue the case lodged by her FIR bearing no. 358/2022 as the matrimonial dispute between the parties stands settled. Respondent no. 2 further states that she has no objection if both the aforementioned FIRs are quashed.

8.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIRs and the proceedings pursuant thereto. There is no legal impediment in quashing the FIRs in question. 9.

Accordingly, FIR bearing no. 358/2022, registered at Police Station Sarai Rohilla, Delhi, for the commission of offence punishable under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
