The appeals have reached for hearing.

Mr.Vikas Mahajan learned counsel for appellant Ramesh Lal informs that son of the appellant informed him that the appellant has expired.

Learned APP for the State shall verify said fact and submit a status report.

Hearing is deferred in Crl.A.No.857/2001 for reason aforenoted. Crl.A.857/2001 & Crl.A.431/2002

As regards Crl.A.No.431/2002, the same has to be heard along with Crl.A.No.857/2001 for the reason both the appellants have been convicted with the aid of Section 34 IPC for the substantive offence of murder. 5.

On an earlier occasion presence of Abhay Singh had to be secured through issuance of a bailable warrant. He as well as his counsel appeared. Neither Abhay Singh nor counsel appeared and therefore we appoint Mr.Harsh Prabhakar as Amicus Curiae to represent appellant Abhay Singh. 6.

Both appeals be listed for direction on May 09, 2016. PRADEEP NANDRAJOG, J.
