% 11.03.2020 Crl.M.A. No. 5260/2020 (for directions) The appeal Crl.A. No. 860/2001 has already been disposed of vide judgment dated 26.2.2014. The matter is taken on Crl.M.A. No. 5260/2020 filed on behalf of the surety of the respondent, i.e., the applicant seeking directions as under:

a. "Direct the Registrar of this Hon'ble Court to remove the seal from the certificate mentioned in para 2;

b. Direct the Syndicate Bank extension Counter DTC Depot GT Karnal Road, Delhi-33 to release the amount of the said certificate along with interest accrued thereon to the applicant."

On behalf of the State, there is no opposition to the prayer made by the applicant. In as much as vide the judgment dated 29.6.2001 in relation to FIR No. 53/94, PS Ali Pur, under Sections 279/304-A of the Indian Penal Code, 1860 vide judgment of the learned Signature Not Verified By:SUMIT GHAI Signing Date:06.08.2020 17:58:12 This file is PS to HMJ ANU MALHOTRA.

Metropolitan Magistrate, the respondent herein had been acquitted and the appeal filed by the State against the said judgment Crl.A. No. 860/2001 was dismissed vide the judgment dated 26.2.2014 of this Court, with the non opposition on behalf of the State, to the prayer made by the applicant seeking removal of the seal from the Vikas Cash Certificate No.91134050000884 in Account No. 5942 dated 15.2.2002 as also qua the prayer made on behalf of the applicant seeking direction to the Syndicate Bank Extension Counter DTC Depot GT Karnal Road, Delhi-33 to release the amount of the said certificate with the interest accrued thereon to the applicant, the prayer is allowed and it is so directed accordingly. The application is disposed of.
