On the last date of hearing, learned counsel appearing on behalf of the Petitioner had submitted that the Petitioner was willing to undertake that it would not participate in any tenders issued by the Respondent.

The matter was accordingly stood over to enable the learned counsel appearing on behalf of the Respondent to seek necessary instructions as to whether the said undertaking would suffice. 3.

Today, Mr. Udit Seth, learned counsel appearing on behalf of the Respondent, submits on instructions that Respondent has no objection if an undertaking is furnished to the effect that the Petitioner shall not participate in any tenders issued either by the Respondent or the Rajasthan Rajya Vidyut Prasar Nigam Limited is given and that the same would suffice.

Learned counsel for the Respondent further submits, on instructions, that no further steps shall be taken by the Respondent in respect of the blacklisting or debarment imposed upon the Petitioner pursuant to the termination order.

Learned counsel for the Petitioner, on instructions, undertakes that the Petitioner shall not participate in any tenders issued either by Rail Vikas Nigam Limited or Rajasthan Rajya Vidyut Prasar Nigam Limited. The Authorised Representative of the Petitioner is also present in Court.

In view of the aforestated undertakings furnished by the parties, this Court is of the view that the present Petition is rendered infructuous.
