W.P.(C) 57/2019 & C.M. No. 371/2019 The first submission of learned counsel for the petitioner is that at the time of hearing, the respondents have produced certain documents to claim that the CCS (CCA) Rules were applicable even before 2016. The Tribunal in paragraph 6 of the impugned judgment takes note of the fact that the documents were tendered at the time of hearing. He submits that no copies of documents were provided to the petitioner and there is no discussion as to what the documents were in the impugned order. Issue notice. Counsel for the respondent accepts notice. Prima facie,

we are of the view that the present may be a fit case for setting aside the impugned order and remanding the case back to the Tribunal for reconsideration after grant of copies of documents to the petitioner relied upon by the respondents at the time of hearing of the Original Application. Counsel for the respondent wishes to take instructions. At request, adjourned to 14.01.2019.
