The present petition under Section 397 of the CrPC (Section 438 of the BNSS) has been filed seeking the following prayers: - "a. Summon the record from the Court of Sh. Pritam Singh, Judge, Family Court-01, South, Saket Courts, Delhi; and set aside the impugned order dated 15-04-2024 passed in M Cases No.224/2023, U/s 125 Cr. P.C.; titled Shruti Gupta Vs. Gaurav Sharma; whereby the Ld. Trial Court was pleased to award maintenance to the respondent at the rate of Rs.30,000/- per month from the date of filing, i.e, 01.06.2023 till the Respondent is legally entitled;

b. Pass any other orders that this Hon'ble Court may deem fit and proper in the interest of justice."

Learned counsel appearing on behalf of the petitioner submits that an application seeking setting aside of the impugned ex-parte judgment has already been filed before the learned Executing Court, and in view of the same, seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law if need so arise. 4.
