The present application under Section 528 of the BNSS seeks condonation of delay of 410 days in filing the present petition. 4.
The impugned order was passed on 22.09.2023. It is the case of the petitioner that the learned Trial Court had passed the order on ad-interim maintenance without granting a single opportunity to the petitioner to file his written statement in the main petition, the reply to the interim application, and his affidavit of assets and liabilities. It is submitted that thereafter, the matter continued and on 29.11.2024, after completion of the part cross-examination of the respondent, the petitioner was informed that an execution petition has been filed with respect to aforesaid ad-interim maintenance order. 5.
