Petitioner seeks anticipatory bail in FIR No. 399/2018 under Sections 353/332/186/506/34 of the Indian Penal Code, 1860 registered at Police Station Sarita Vihar.

The allegations in the FIR are that the petitioner along with coaccused had gone to the veterinary hospital for check-up of their dog. However, doctors were busy in some official duty. It is alleged that the petitioner along with other co-accused misbehaved with the doctors and thereafter assaulted them with sticks and lathis and also ransacked the hospital.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is a young boy of 20 years and is a student with clean antecedents. He submits that the nature of injury sustained as per the FIR, is simple and the injured were discharged after first aid. He further submits that the petitioner is willing to join investigation as and when so required by the Investigating Officer.

Issue notice. Notice is accepted by learned Addl. PP for the State. Status report be filed on or before the next date of hearing. 5.

Subject to petitioner's joining investigation, no coercive action shall be taken against the petitioner till the next date of hearing. 6.

At the request of learned Addl. PP, petitioner is directed to appear before the Investigating Officer on 09.01.2019 at 4.00 PM at Police Station Sarita Vihar.
