O R D E R

% 13.01.2017 Crl.M.A. 652/2017 Exemption allowed subject to just exceptions. By the present petition the petitioners seek quashing of FIR No. 345/2016 under Sections 323/341/354A/506/34 IPC registered at PS Sagar Pur, Delhi on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. Learned Additional Standing Counsel for the State on instructions from Investigating Officer submits that in the above-noted FIR the four petitioners are the accused of which petitioner No.4 is a minor and respondent No.2 the complainant/ victim and besides her respondent No.3 to 6 are the other victims. He states that no other person is involved in the FIR.

Respondent Nos. 2 to 6 are present in Court and are identified by the learned counsel and the Investigating Officer. They state that the quarrel took place between the families of two brothers, as petitioner No.1 & 2 are brothers of respondent No.3, however thereafter due to the intervention of elders in the family a settlement was arrived at and a compromise deed executed in this regard on 16th December, 2016. As per the settlement both the parties are withdrawing their cross-cases and do not wish to pursue the above-noted FIR and the proceedings pursuant thereto. Petitioners No.1 to 3 and petitioner No.4 though his father/ legal guardian i.e. petitioner No.2 who are identified by the learned counsel affirm the statement of respondent No.2 to 6 and state that they will maintain peace and tranquillity in future and will give no cause of grievance to the other side. They state that they will abide by the terms of settlement arrived at between the parties.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.

345/2016 under Sections 323/341/354A/506/34 IPC registered at PS Sagar Pur, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
