Learned counsel for petitioner submits that learned Trial Court has already examined 26 out of 51 witnesses and, according to him, from the evidence so far recorded, the case in hand does not seem to be a case of homicide and, at best, it could either be a case of accidental death or a case of natural death.

After hearing arguments for some time, learned counsel for the petitioner, without prejudice to his rights and contentions, does not press the present application. He, however, prays that a request be made to the learned Trial Court to expedite the trial.

The petition is, accordingly, dismissed as not pressed. All rights and contentions of the parties are reserved.

material witnesses have already been examined, learned Trial Court is requested to expedite the recording of evidence of remaining witnesses and to make best efforts to dispose of the abovesaid case as expeditiously as possible, preferably, within one year from the date it takes up the matter. 5.
Both the sides shall render due assistance and cooperation to learned Trial Court to achieve such expeditious disposal. 6.
Needless to say, the petitioner would be at liberty to file application afresh before this Court at a subsequent stage.
