The defendant, Mr. Manish Goyal, who is present in Court, submits that he wishes to settle the present case with the plaintiff. He undertakes not to use impugned mark 'MANAPPURAM GOLD' or any other marks deceptively similar to the plaintiffs' marks in the future in any manner whatsoever in India or any other country. He further submits that he does not possess any products, packaging, labels, etc. bearing the impugned mark. 2.
He also confirms that he has filed a letter of withdrawal seeking withdrawal of his trademark application for the mark 'MANAPPURAM GOLD' dated 20th November, 2024 and pursuant to the said letter, the Trade Mark Registry has withdrawn the registration application. 3.
Counsel for the plaintiff submits that the plaintiff is agreeable to the settle the dispute with the defendant no.1 on the aforesaid terms. It is further submitted that the plaintiff is ready to give up the remaining reliefs claimed in the suit.

In view of the above, a decree of permanent injunction is passed in favour of the plaintiffs and against the defendant in terms of prayer clauses 72 (a), (b), (c), (d).

Let the decree sheet be drawn up.

Since the matter has been settled at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870, read with Section 89 of the Code of Civil Procedure, 1908. 7.
All pending applications stand disposed of.
