The present appeal has been filed under Section 374 of Cr.P.C. challenging the judgment dated 2nd September, 2002 passed by ASJ, New Delhi, in case FIR no. 647/2001 under Sections 302/201 IPC, registered at PS Defence Colony, Delhi by which the Appellant was convicted for imprisonment for life along with a fine of Rs. 500/-, in default of payment of fine, Simple imprisonment for 3 months under Section 302 IPC and Rigorous Imprisonment for 2 years along with a fine of Rs. 500/-, in default of payment of fine, Simple imprisonment for 3 months under Section 201 IPC. In this matter vide order dated 8th August, 2007, the sentence of the appellant was suspended.

Miscellaneous Matters'. Steps were to be taken to serve the Appellant. However, at that stage it has been revealed that the Appellant has, in fact, passed away on 15th May, 2021. Status report dated 11.07.2024 has been filed by SHO PS Defence Colony verifying the death of the Appellant due to Covid in Chhattisgarh.

In view of the above fact, the appeal no longer survives and accordingly abates. The appeal is disposed of with all pending applications, if any. 5.

The surety also stands discharged and the documents furnished by the surety may be returned to the surety.
