Learned counsel for the respondent no.2, appearing on advance notice, submits that the present petition is not maintainable for want of jurisdiction as also since the original charge-sheet had predicate offences clearly mentioned therein.

Though the learned counsel for the petitioner disputes the same, however, upon instructions, he seeks to withdraw the present petition with liberty to approach the appropriate forum if, as and when required, in accordance with law.

Accordingly, the present petition is dismissed as withdrawn with liberty as prayed for.
