This is a joint application on behalf of the petitioner and the respondent no.1 under Order XXIII Rule 3 of the Code of the Civil Procedure, 1908 seeking disposal of the present petition in terms of Settlement Agreement dated 24.01.2025 [Annexed to the present application].

The present application is duly supported by affidavits of the authorized representatives of the petitioner and respondent no.1. 3.

Learned counsels of the parties confirm the terms of the settlement and identify the signatures of their respective clients and pray that the suit be decreed in terms of the Settlement Agreement dated 24.01.2025. 4.

the petitioner and respondent no.1 and finds them to be lawful. 5.

In view thereof, the present application is allowed and disposed of. C.O. (COMM.IPD-TM) 171/2022 6.

The learned counsel appearing for the petitioner, in view of the settlement entered inter se the petitioner and respondent no.1 prays that since the dispute between the petitioner and respondent no.1 has been amicably settled, therefore, the present petition be disposed of on the terms thereof.

In view of the aforesaid, nothing survives in the present petition qua respondent no.2.

Accordingly, the present petition is disposed of in terms of the Settlement Agreement dated 24.01.2025.

The petitioner and respondent no.1 shall remain bound by the terms of Settlement Agreement dated 24.01.2025. 10.
