The Petitioners denied the benefit of pay scale up-gradation to Hindi Translators Cadre Employees, notwithstanding the recommendations of the 5th Central Pay Commission. Aggrieved thereby, the employees approached various Benches of the Central Administrative Tribunal. The issue came to be decided in favour of the employees.

The Union of India filed Writ Petitions before Calcutta High Court and Karnataka High Court, which were also decided in the favour of the employees. A Special Leave Petitions filed by the Union of India was dismissed vide a detailed judgment passed on 25.07.2013 by the Supreme Court in SLP (Civil) 17419/2009 captioned Union of India & Ors. vs. Rajesh Kumar Gond and other connected cases. In one case, even leave to appeal was granted and it was converted into a Civil Appeal. Another Special Leave Petition filed by the Union of India, being SLP (Civil) No. 27542/2012, captioned Union of India & The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Ors. v. Mohan Choudhary, was also tagged with the aforesaid matters.

Despite aforesaid position, the Petitioners once again declined to implement the law laid down by the Supreme Court. The employees consequently filed Original Application (OA) which has been allowed. The Respondents herein are also Junior Hindi Translators. 4.

Learned counsel representing the Petitioners despite his best efforts failed to draw the attention of the Court to any distinguishing feature between the case of employees who were before the Supreme Court and the Respondents herein.

In the aforesaid circumstances, no ground is made out for interference in the exercise of writ jurisdiction. The present writ petition is accordingly dismissed. All the pending applications are also disposed of.
