% 09.01.2019 CM 657/2019 (exemption)

1. Exemptions allowed, subject to all just exceptions. W.P.(C) 125/2019

2. Notice. Notice is accepted by Mr Ravi Prakash, learned CGSC for the UOI/ R-1 to 5. He seeks some time for taking instructions.

3. On the next date, learned counsel for the Respondents will inform the Court of the decision taken by the Respondents on the representation dated 23rd December, 2018 submitted by the Petitioner against his posting order.

4. List on 14th February, 2019.

CM 656/2019 (stay)

5. The Court fails to appreciate how the Petitioner could simply presume

that submitting a representation against the movement order, will tantamount to the stay of that order. Learned counsel for the Petitioner states that the Petitioner was on sanctioned leave till 6th January, 2019 and, therefore, he did not comply with the movement order till then. Today is 9th January, 2019. No excuses are left for the Petitioner not to comply with the movement order. His so complying with the order would be subject to the result of the present petition.

6. The application is dismissed.
