O R D E R

The present contempt petition has been filed alleging willful disobedience of the order dated 06th December, 2023 passed in W.P.(C) No. 15704/2023.

By the aforesaid order, the respondent no.1-Union of India ("UOI") was directed to consider the application made by the suppliers of the petitioner for Bureau of Indian Standards ("BIS") certification within a period of six weeks from the date of the said order. On the last date of hearing, learned Standing Counsel appearing for the respondent no.1-UOI has submitted that though directions had been issued to the UOI for considering the applications for BIS certification, however, it is the respondent no.2-BIS that had to actually consider the application of the petitioner for the purposes of BIS certification. 4.

Thus, Mr. Anil Kaushik, learned Senior Counsel appearing for respondent no.2-BIS had confirmed the said fact that as far as the issue of certification is concerned, the same is to be dealt by the BIS. Thus, the matter was notified for today, so that the BIS could take the requisite action in that regard.

Today, learned Senior Counsel appearing for the BIS has handed over copies of three rejection notices dated 27th March, 2024. The same are taken on record.

By way of the aforesaid rejection notices dated 27th March, 2024, the BIS has rejected the application of the petitioner for BIS certification, on various grounds.

Accordingly, the order dated 06th December, 2023 passed in W.P.(C) No. 15704/2023 stands complied with, as the application of the suppliers of the petitioner has been rejected by the respondent no.2-BIS. 8.

Accordingly, no further orders can be passed in the present contempt petition. However, liberty is granted to the petitioner to challenge the said rejection notices in accordance with law.
