This petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.') seeking quashing of the Complaint Case filed by the respondent no.2 under Section 138 of the Negotiable Instruments Act, 1881 (in short, 'NI Act') being CC No. 46287/2016, titled as M/s MOI Commodities India Pvt. Ltd. v. Pradeep Saraf & Ors., and the proceedings under Section 82 of the Cr.P.C. initiated in those proceedings.

The learned counsels for the petitioners and the respondent no.2 submit that the parties have since settled their disputes and have entered into a Settlement Agreement dated 24.05.2023 before the Delhi High Court Mediation and Conciliation Centre, and the respondent no.2 has no objection if the complaint case as also the proceedings emanating there from are quashed. 3.

Damodar S. Prabhu v. Sayed Babalal H., (2010) 5 SCC 663, the complaint case, being CC No. 46287/2016, and the proceedings under Section 82 of the Cr. P.C. initiated therein, are quashed, subject to the petitioners depositing a sum of Rs.10,000/- jointly or severely with the Delhi State Legal Services Authority within a period of two weeks from today.

The petition and the pending application are disposed of in the above terms.
