Petitioner seeks quashing of summoning order dated 06.01.2021, primarily for the reason that he is neither the signatory of the subject cheque nor the cheque was issued from his account.

It is noticed that when the present petition was taken up on 01.03.2023, while issuing notice, the impugned order was directed to be stayed. 3.
Learned counsel for respondent No.2/complainant submits that the grievance of the petitioner has already been taken care of as the complainant has already made a statement before the learned Trial Court on 29.10.2025 to the effect that he does not wish to proceed with his abovesaid complaint qua accused No.2-Mr. Gaurav Sharma (petitioner herein). 4.

learned Trial Court, however, in view of the stay operating in the present matter, no order could be passed.

Learned counsel for the petitioner submits that in view of the above, he does not press the present petition and the learned Trial Court may be requested to pass appropriate order in view of the statement made by the complainant on 29.10.2025.

The petition is, accordingly, disposed of as not pressed. 7.
Pending applications also stand disposed of in aforesaid terms. 8.
Needless to say, in view of the above, the interim order stands vacated. 9.
Learned Trial Court is requested to pass appropriate order in view of the statement made by the complainant, on the next date of hearing i.e. 24.03.2026 and, may also make sincere effort to dispose of the entire complaint, as expeditiously as possible.
