By way of present petition, the petitioner seeks cancellation of anticipatory bail granted to the respondent vide order dated 08.02.2023 passed by ld. ASJ (POCSO), South East, Saket, Delhi in Bail Application No. 186/2023.

Mr. Singh, learned Sr. Standing Counsel for the petitioner, on instructions, submits that prosecution is contemplating filing of complaint after obtaining approval from the Competent Authority. He further submits that the respondent has violated the conditions of bail, inasmuch as, he has not deposited his passport and even the summons issued to him at the given address were returned unserved with the remarks, 'left without address'. He, thus, contends that the respondent has changed his residential address without intimation to the concerned I.O.

Mr. Manan, ld. Senior Counsel for the respondent, on the other hand, submits that the respondent has been regularly joining the investigation, and lastly joined on 22.08.2024 and 23.08.2024. He, on instructions, further submits that the respondent has not changed his residential address and rather, has appeared before the concerned Authority in pursuance to the summons received at the said address. Ld. Senior Counsel, on further instructions, submits that the respondent undertakes to appear before the concerned I.O. as and when the summons are received. On the aspect of non deposit of passport, it is submitted that the same would be deposited within a week from today. It is also submitted that in case of change of any contact details of the respondent, the same shall also be brought to the notice of the concerned I.O. immediately.

Considering the aforesaid, no ground is made out to entertain the present petition and consequently, the same is dismissed. Order Dasti.
