Appellant has filed an appeal for reduction of the award dated 27.07.2022 passed by the learned MACT awarding compensation of Rs.15,52,636.96 along with interest @ 9% from the date of filing of the claim petition. On appeal, the Insurance Company deposited 75% of the awarded amount along with accrued interest and the said amount has already been released in favour of the claimants.

In MACA No.343/2022, both the parties have settled the said appeal in lump sum enhancement of Rs.2,25,000/- over and the above the awarded amount has full and final settlement.

In view of the settlement in MACA No. 343/2022, Ld. Counsel for the appellant has instructions to withdraw the appeal. Insurance Company is required to deposit 25% of the balance awarded amount along with accrued interest from the date of claim petition till the date of deposit. Ld. Counsel for the insurance company has requested for some time deposit the said amount.

In view of the above, the Insurance Company is directed to deposit 25% of the balance awarded amount along with accrued interest from the date of the claim petition till the date of deposit within 06 weeks from today before the Registrar General of this Court failing which it shall carry interest @ 9% p.a. on the delayed deposit. The said amount be released to the respondent/claimant as per the proportion of the Award subject to fulfilment of the requisite formalities.

The statutory amount with interest, if any, be refunded to the Insurance Company.
