% 10.01.2019 Crl.M.A.378/2019 (exemption) Exemption is allowed subject to all just exceptions. BAIL APPLN. 45/2019 1.

Petitioner seeks anticipatory bail in FIR No.289 of 2018 under Sections 323/452/427/506/34 of the Indian Penal Code, 1860, Police Station Jagat Puri.

Allegations in the FIR are that the complainant along with his brother were going on the street when he was confronted by 2-3 boys and an altercation took place. Thereafter the neighbours intervened and the boys left the spot. Subsequently, boys came with other persons and entered the house of the complainant and dragged the complainant out of the house. It is alleged that petitioner along with BAIL APPLN. 45/2019

other co-accused beat the complainant, his brother and other neighbours.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated.

Police file has been perused which shows that nature of injury sustained are simple and all the injured were discharged after first-aid. 5.

Issue notice. Notice is accepted by learned APP. Let status report be filed within four weeks.

List for consideration on 05.02.2019.

In the meantime, subject to petitioner joining investigation, no coercive action shall be taken against the petitioner till the next date of hearing.

At request of learned APP for the State, petitioner is directed to appear before the Investigating Officer on 11.01.2019 at 4 PM at Police Station Jagat Puri.
