The present appeal under Section 374 of the CrPC challenges the judgment of conviction and order on sentence dated 05.07.2003 and 07.07.2003 respectively, passed by learned ASJ in Sessions Case No. 27/1998 arising out of FIR No. 182/1998, under Sections 489A, 489B/489C/489D of the IPC, registered at P.S. Malviya Nagar. 2.

Report with regard to the notice issued to appellant has come back unserved with remarks „left the last known address‟. 3.

Report with regard to the notice issued to surety of the appellant has come back unserved with remarks that the latter has since passed away. 4.

Nominal roll reflects that the appellant has already undergone sentence awarded to him. It is further reflected that the sentence was completed on 18.10.2004 and appellant was released from jail on 08.02.2006 after completing the sentence in other cases and payment of fine awarded to him.

Learned counsel appearing on behalf of the appellant appointed by Delhi High Court Legal Services Committee submits that he does not have any instructions with regard to the present appeal. It is further submitted that he has no knowledge with regard to the present appellant. 6.

In view of the above, the present appeal is dismissed in default for non-prosecution and disposed of accordingly.
