The present appeal under Section 374 of the Cr.P.C. challenges the judgment and order on sentence dated 29.08.2003 and 08.09.2003, respectively passed by Sh. R.K. Yadav, Additional Sessions Judge, Delhi in SC No. 67/2003, arising out of case R.C. No. 1/1974-SIU, under Sections 120B read with Section 420/109/466/468/471 of the IPC, registered at P.S. SPE/CBI/SIU/R.K. Puram/New Delhi.

The appellant was convicted under Section 120B read with Section 109/466/468/471 of the IPC. The appellant was sentenced to undergo 03 years of rigorous imprisonment for offence under Section 420 of the IPC alongwith fine of Rs. 50,000/-.In default of payment of fine, further rigorous imprisonment for 06 months. The appellant was further sentenced to undergo rigorous imprisonment for 03 years for offences punishable under Sections 466/468/471 of the IPC alongwith fine of Rs. 50,000/-. In default of payment of fine, further rigorous imprisonment for 06 months. directed that all sentences would run concurrently. 3.
It was pointed out on the last date of hearing, i.e., 05.03.2024, that the present appellant has since passed away on 22.04.2020 and the copy of the death certificate was supplied to the learned SPP for the CBI and it was directed to be verified.

Status report dated 16.04.2024, authored by Mr. Ajit Yadav, PC/CBI, EO-II, New Delhi, verifying the factum of death of the appellant, has been handed up in Court today and is taken on record. 5.
In view of the above, the present appeal stands abated and disposed of accordingly.
