This writ petition is filed by the Petitioners seeking restitution of property bearing Property No.25, Najafgarh Road, New Delhi. After canvassing some arguments, learned counsel for the Petitioners, on instructions, seeks to withdraw this writ petition with liberty to take recourse to appropriate legal remedies to seek restitution of the subject property. It is, however, urged that on account of an illegal demolition of the part of the premises carried out by MCD, in the absence of the Petitioners, debris is lying in the property and is causing hindrance to the ingress and egress of the Petitioners and therefore, the MCD be directed to remove the debris or Petitioner be permitted to remove the same at the cost of MCD. 2.

Learned counsel appearing for the MCD, on instructions, submits that MCD is under no obligation to remove the debris and it is open to the Petitioners to do so at their own cost.

Accordingly, this writ petition is disposed of as withdrawn with liberty to the Petitioners to take recourse to appropriate legal remedies to seek restitution of the subject property or a part thereof, as the case may be. Petitioners are permitted to clear the debris lying in the subject property at their own cost.
