By way of the present petition, the petitioner seeks grant of parole in FIR No.862/2016 under Sections 302/201/120B/34 of the Indian Penal Code, 1860 (IPC) registered at Police Station Shahbad Dairy. 2.

The petitioner has been in judicial custody since 17th March, 2017. 3.

The petitioner was convicted of offences under Sections 302/201/120B/34 of the IPC and sentenced for life. 4.

The appeal filed on behalf of the petitioner was dismissed on 26th June, 2023.

The Special Leave Petition (SLP) filed against the aforesaid judgment has also been dismissed.

The petitioner seeks grant of parole on the ground that the son of the petitioner is appearing in Class X Board Examination. 7.

As per the Status Report on record, it has been verified that the son of the petitioner is to appear in Class X Board Examination which is to be held in February/March, 2024.

It is an admitted position that the petitioner has been granted interim bail on various occasions and has not misused the liberty. It is also not disputed that the conduct of the petitioner in jail has been satisfactory. 9.

Accordingly, it is directed that the petitioner be released on parole for a period of four weeks, subject to the petitioner furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent on the following conditions: i.

The petitioner shall not leave the country during the period of parole, without the prior permission of the Court.

ii.

The petitioner shall provide his mobile number to the concerned SHO, which shall be kept in working condition at all times, and shall not switch off or change the mobile number without prior intimation to the concerned SHO. The mobile location be kept on at all times. iii.

The petitioner shall surrender before the Jail Authorities on expiry of the period of his parole.

Accordingly, the present petition is disposed of. 11.

A copy of this order be sent to the Jail Superintendent for information and compliance.
