Petition under Article 226 of the Constitution of India read with Section 482 the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for quashing of FIR No.0014/2023 under Section 420 IPC registered at P.S.: Cyber Police Station (South West), Delhi. 2.
Learned ASC for the State appears on advance notice. 3.
In brief, present FIR was registered on complaint of Kailash Chandra Dwara who alleged that on 27.02.2023, he had made a call at the customer care centre of the RBS Bank to obtain bank account statements of his daughter. A person posing as a bank employee asked him to authenticate his bank account details through online mode, and also instructed to fill his debit card details. Learned counsel for the petitioner submits that the petitioner is innocent with no connection with the alleged transactions and has already been admitted to bail by learned CMM, Patiala House Courts, New Delhi vide order dated 25.05.2023.

On the other hand, petition is opposed by learned ASC for the State and it is submitted that the case is still under investigation and the location of the relevant phone calls was traced to Jamtara. Further, there is a scam involving several persons and a notice under Section 41A Cr.P.C. has been issued to Jio Point Manager, Bireshwar Chakrobarty.

At this stage, learned counsel for the petitioner after making some submissions, does not press the petition.

Taking the statement of learned counsel for the petitioner on record, petition is disposed of as not pressed. Pending applications, if any, also stand disposed of.
