Writ Petition under Article 226 of the Constitution of India read with Section 482 of Code of Criminal Procedure has been filed on behalf of the Petitioner for quashing of Punishment Tickets dated 05.03.2021, 16.06.2022 and 26.08.2022 and Appraisal Order dated 04.09.2021 passed by learned Inspecting Judge, on the ground that due procedure, as prescribed for awarding punishment, has not been followed.

Learned counsel for the State has placed reliance on Order dated 28.04.2023 passed by Co-ordinate Bench of this Court in W.P.(CRL)1168/2023 titled as Sukash Chandrashekhar @ Sukesh vs. State Govt. NCT of Delhi; Order dated 01.02.2024 passed by Co-ordinate Bench of this Court in W.P.(CRL) 2272/2022 titled as Chander Kant Jha vs. State of NCT of Delhi; and Judgment dated 19.03.2024 passed by Co-ordinate Bench of this Court in W.P.(CRL) 1912/2023 titled as Mukesh (in JC) vs. State of NCT of Delhi.

In view of aforesaid judgments, impugned Orders are set aside and the matter is remanded back to the Jail Authorities to decide these Punishment Tickets, in accordance with law.
