% 09.02.2024 [Physical Hearing/Hybrid Hearing (as per request)] 1.

In these proceedings, order of the Additional Rent Controller allowing leave to contest has been challenged by the petitioner/landlord. After part arguments, keeping in mind that trial has already commenced and petitioner/landlord has already been partly cross-examined, both sides agreed that the present petition can be disposed of with certain directions. Accordingly, as requested by both sides, this petition is disposed of with the following directions:

(i) On 03.04.2024, when trial is listed before the Additional Rent Controller, learned counsel for respondent/tenant shall conclude cross-examination of the present petitioner PW-1. (ii) Within four weeks, the respondent/tenant shall file before the Trial Court a list of witnesses and as assured by counsel for respondent/tenant on instructions, he shall examine only four witnesses including the present respondent/tenant. (iii) In view of the ground on which leave to contest was allowed, the learned Additional Rent Controller is requested to dispose of the entire matter within a period of six months from today.

(iv) Both sides are directed not to seek adjournments unless absolutely necessary.

(v) To ensure compliance, a copy of this order be given dasti to both sides and they shall present the same before the learned Additional Rent Controller within one week. 2.

Accordingly, the present petition is disposed of.
