% 12.01.2017 Issue notice. Mr. Katyal accepts notice on behalf of the State. The petitioner has preferred the present writ petition primarily to seek a direction to the respondent to grant protection to her and her family members from one Neelam Kaur, Sita Ram and her sons. The case of the petitioner is that there was an earlier incident in which she was beaten up by the said persons which led to registration of FIR No.664/2016 on 16.11.2016 under Sections 325/ 341/ 506/ 34 IPC. According to the petitioner, the said persons have again issued threats that
they would harm the petitioner and her family members and also involve them in other cases. The petitioner gave a complaint to this effect on 18.12.2016. The grievance of the petitioner is that despite the said communication, neither any FIR has been registered even though it disclosed commission of a cognisable offence, nor she has been provided protection.
So far as the grievance with regard to non-registration of the FIR is concerned, that is a matter which the petitioner could agitate before the learned Magistrate by moving an application under Section 156(3) Cr.P.C. in case the FIR is not being registered by the police. The SHO, PS - Sangam Vihar, South East District, Delhi is directed to make an assessment of the threat perceived by the petitioner from the aforesaid persons and provide protection to the petitioners and family members after assessing the threat perceived by them. The Beat Constable of the area shall be sensitised in the matter, who shall keep a tab on the petitioner and the said persons. They shall also be counselled not to take law into their hands.
The petition stands disposed of in the aforesaid terms. Dasti.
