% 30.07.2019 The present petition has been filed by the petitioner with the following prayers:
"In these circumstances it is therefore, most respectfully prayed that your Lordships may very graciously be pleased to grant order / direction:- a) For issuance of a Writ / Order / Direction in the nature of Writ of Mandamus, directing the Respondent from sealing or taking any coercive action against the petitioner's plot / premises bearing commercial shop Municipal No. 1496, Gali No. 101/106, Ground Floor, Ganesh Pura, Tri Nagar, North West Delhi, Delhi - 110035 measuring 48 meters holding that the same is situated in the Mixed land Streets Area.
b) It is also prayed that the respondent may kindly be restrained from taking any coercive action of sealing the plot / premises bearing Municipal No. 1496, Gali No. 101/106, Ground Floor, Mixed Land Use Area, Ganesh Pura, Tri Nagar, North West Delhi, Delhi - 110035 measuring 48 meters till the final disposal of
the present writ petition.
Any other or further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case be also passed in favour of the applicant / petitioners and against the respondent to meet the ends of justice."
Learned counsel appearing for the respondent Nr. DMC states, no sealing order has been passed against the property being Commercial Shop, Municipal No. 1496, Gali No. 101/106, Ground Floor, Ganesh Pura, Tri Nagar, North-West Delhi, Delhi - 35.
In view of the submission made by learned counsel appearing for respondent Nr. DMC., the petition being pre-mature, learned counsel for the petitioner seeks to withdraw the petition.
The petition and the connected application are dismissed as withdrawn.
